Terms of Service
1. Introduction
These Terms of Service (“Terms”) are a legal agreement between Fresh Start Gardening and Maintenance (hereinafter referred to as “the Company” or “We”) and the customer (hereinafter referred to as “You” or “the Customer”). By using our gardening and maintenance services, you agree to be bound by these Terms.
2. Services
2.1. Fresh Start Gardening and Maintenance offers a range of gardening and maintenance services, including but not limited to lawn care, landscaping, pruning, planting, and general outdoor maintenance.
2.2. You agree to provide accurate information regarding your service requirements and location for the services to be performed.
3. Pricing and Payment
3.1. Pricing for our services will be provided to you upon request or as specified in a written estimate.
3.2. Payments for services must be made in accordance with the terms agreed upon in the estimate or invoice. We accept cash and electronic payments as specified by the Company.
4. Cancellation and Rescheduling
4.1. To cancel or reschedule a service appointment, you must provide us with at least 24 hours notice. Failure to do so may result in a cancellation fee.
4.2. The Company reserves the right to cancel or reschedule appointments due to adverse weather conditions or unforeseen circumstances. We will make reasonable efforts to inform you as soon as possible in such cases.
5. Customer Responsibilities
5.1. You are responsible for ensuring that our team has safe and unobstructed access to your property on the scheduled service date.
5.2. You agree to inform us of any hazards, obstacles, or specific requirements related to the services.
6. Liability
6.1. While the Company takes reasonable care while performing services, we are not liable for any damage to property, injury, or accidents that occur on your premises during service delivery.
6.2. You agree to indemnify and hold the Company harmless against any claims, damages, or liabilities arising from the services performed, except in cases of negligence on our part.
7. Warranty
7.1. We provide a limited warranty for the services rendered. If you are not satisfied with our services, please contact us within 48 hours of service completion, and we will make reasonable efforts to rectify the issue.
8. Privacy
8.1. We respect your privacy and will handle your personal information in accordance with our privacy policy, which can be found on our website.
9. Termination
9.1. Either party may terminate this agreement at any time with written notice. Outstanding payments must be settled upon termination.
10. Governing Law
10.1. This Agreement shall be governed by and construed in accordance with the laws of New Zealand.
11. Entire Agreement
11.1. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, whether written or oral.
By using our services, you acknowledge that you have read, understood, and agree to abide by these Terms of Service.
